In a period of economic difficulty like the current one, it is possible to request a rent reduction for both residential and commercial properties. The property owner and the tenant can, in fact, enter into an agreement and both benefit from the advantages provided: the tenant will be relieved of the burden of paying the full rent amount, and the landlord will not have to pay taxes on the portion of rent not collected.

Rent Reduction: Who Can Benefit

The agreement applies to all contracts, those with an ordinary taxation regime and those with flat-rate tax. The important thing is to enter into the contract within 30 days of the current month to pay taxes only on the rent collected. To do this, it is necessary to draw up a temporary contract in which the two parties agree and complete Form 69. No registration fees are required for these procedures and the deed is exempt from stamp duty as stated in Article 10 of Legislative Decree 133/2014.

Where to Find Form 69 and How to Complete It

You can download Form 69 from the Revenue Agency website and complete it. Among the points to fill out you will find:

  • General data of the person requesting registration, date of execution and end of extension
  • Data of the parties subject to the legal effects of the deed
  • Descriptive data of the deed (transaction code, etc.)
  • Property data
  • Additional property data

Once you have completed the form and the deed attesting to the agreement between the two parties, both must be sent to the same Revenue Agency office where the previous contract was registered. For now, it is sufficient to send the documentation electronically, but once the coronavirus emergency is over, it must also be deposited at the office in original form.
